Start the project by importing only the 4K video. That will set the project to 4K. Then bring in the background after it and move the video on top of the background. Check to make sure you can export 4K before doing any other editing.

iMovie uses the first thing you import to determine the resolution of the whole project. So it has to be 4K (3840x2160) video in or for it to be 4K. My guess is that starting with a photo isn't going to do it, or perhaps your photo isn't exactly 3840x2160 or something.

I really really appreciate you helping me out and the photo resolution is much more than what you typed there I mean it is 4K HD I was on call for hours with Apple care representative and now they say that this is an unexpected behaviour of the iMovie and I don’t want to give my laptop for repair because it is very new one so the idea that you told me is working but do you think it is actually an iMovie error or I can continue using the idea?

MK: But did you try what I suggested? Start a new project and bring the 4K VIDEO in first. Then the photo. Then arrange them.
